Buying a subsale property in Selangor

A subsale (resale) home is bought from its current owner: you see the actual unit, the view and the neighbours, and you can move in or rent it out within months. This guide sets out the steps, the real costs and the checks, with recorded and asking prices for the 26 Selangor projects on this site.

The process

Steps to buy a subsale property

  1. Set your budget. Get a bank pre-assessment. Banks usually lend up to 90% for your first two properties and up to 70% from the third.
  2. Compare prices. Set asking prices against recorded transactions in the same building (NAPIC open data, EdgeProp, or ask Jason).
  3. View and check. Defects, water pressure, parking and the management office’s statement of arrears.
  4. Offer and earnest deposit. An offer to purchase with an earnest deposit, usually 2% to 3%, subject to contract.
  5. SPA and the 10% deposit. Your lawyer searches the title and the seller, then you sign the SPA and pay the balance of the 10%.
  6. Loan and consents. The bank values the unit. State consent is needed for foreign buyers and for some leasehold or restricted titles in Selangor.
  7. Completion and keys. Usually 3 months from the SPA or consent, with a 1-month extension at interest; then the title is transferred and the keys handed over.

Selangor rules

What applies to foreign buyers and sellers in Selangor

State rules as summarised on the Selangor property page; confirm the current position with your lawyer before you sign.

Minimum price, Zones 1 and 2: RM2 million

Foreign individuals and companies may buy a strata or landed-strata home in Zone 1 (Petaling, Gombak, Hulu Langat, Sepang and Klang districts) or Zone 2 (Kuala Selangor and Kuala Langat) only at RM2 million or more. Petaling Jaya, Subang Jaya, Shah Alam, Puchong and Cyberjaya are all in Zone 1.

Minimum price, Zone 3: RM1 million

In Hulu Selangor and Sabak Bernam districts the minimum for strata and landed-strata homes is RM1 million.

Strata and landed strata only

Homes on an individual title (most terraces, semi-detached houses and bungalows) are closed to foreign buyers. Gated homes with a landed-strata title are open at the zone minimum.

Commercial and industrial: RM3 million

Shops, offices and factories need RM3 million or more in every zone. Agricultural land is not open to foreign buyers.

Units a foreigner cannot buy

Bumiputera-quota units, low-cost and low-medium-cost homes, and Malay reservation land. The 2014 state circular, as reported, also caps foreign purchases at 10% of a project’s non-Bumiputera units.

State consent from PTG Selangor

Every purchase needs State Authority consent under section 433B of the National Land Code. Your lawyer files the application (Borang 433B) with the Selangor Land and Mines Office (PTG Selangor) in Shah Alam, and the Director of Lands and Mines decides. The application fee is RM200 per title, or RM1,000 for an appeal.
