Japanese families and investors look at Johor Bahru for international schools, freehold homes and its link to Singapore. This page sets out Malaysia’s rules for foreign buyers, the Japan side, a cost example and the steps.
Malaysia’s rules for foreign buyers in Johor
| Rule | What it means for you |
|---|---|
| Minimum price | Generally RM1 million or more per property in Johor, for both apartments and landed homes. |
| State consent | Johor state approval is needed for every foreign purchase. Your lawyer applies for consent. Since 1 July 2025 Johor’s consent levy for foreign buyers is 3% of the price or RM30,000, whichever is higher (PTG Johor Circular 1/2025), plus application fees. |
| Not open to foreigners | Bumiputera lots, low-cost and affordable units, Malay Reserve land, and single or one-and-a-half-storey terraces. |
| Stamp duty on transfer | 8% of the price for foreign buyers of homes from 1 January 2026. |
| Selling later (RPGT) | 30% of the gain within five years; 10% from the sixth year. |
| Source of funds | Malaysian lawyers and banks must check where the purchase money comes from, so keep clear bank records of every transfer. |
| Residence | Owning property does not give you the right to live in Malaysia. Long-stay programmes such as MM2H are separate applications. |
The Japan side
- Sending money. There are no exchange controls, but banks report overseas remittances above ¥1 million to the tax office.
- Foreign asset report. Japanese residents whose overseas assets exceed ¥50 million at year-end must file a foreign asset report (国外財産調書).
- Rental income. Rent from a Malaysian property is taxable in Japan for residents, with credit for Malaysian tax; rules limit using depreciation losses on overseas used buildings. Ask your tax accountant.
