Sarawak property
Kuching is Sarawak’s capital and its main property market, with prices well below Kuala Lumpur and Johor Bahru. Sarawak runs its own land law, so the rules for foreign buyers differ from the peninsula: strata units have no state minimum price, but every foreign purchase needs state approval and native land is off limits. These six completed projects cover the riverfront, Batu Lintang, Tabuan, Stutong and Jalan Song.

Sarawak by area
| Area | What it is known for |
|---|---|
| City centre and Petanak | The old town and Sarawak River waterfront; riverfront condominiums such as Kuching Riverine Resort. |
| Batu Lintang | Naim’s Kuching Paragon masterplan between the city and the airport, with Gleneagles Hospital under construction and an ART station planned. |
| Tabuan | Tabuan Jaya and Jalan Wan Alwi, built around Vivacity Megamall, with mid-priced condominiums. |
| Stutong | Established residential area near The Spring, CityONE, Swinburne University and private hospitals. |
| Jalan Song | Mature suburb with commercial centres, Friendship Park and low-rise condominiums. |
| Petrajaya | The state government quarter on the north bank. Much of the land is Native Area Land, so few homes there are open to non-native or foreign buyers. |
| Miri | Sarawak’s northern oil town. Not covered here yet: we did not find a completed project with enough published records to check. |

The rules for foreigners buying in Sarawak
Sarawak has its own rules, set by the state. Confirm the current position with a lawyer in Sarawak before you pay a booking fee.
| Rule | What it means |
|---|---|
| Sarawak Land Code (Cap. 81), not the National Land Code | Sarawak has its own land law. Section 13A bars foreigners from holding land unless an exception applies. Source: Mondaq / Low & Partners; S.K. Ling & Tan Advocates. |
| Strata units: allowed, no Sarawak minimum price | Section 13E(2)(b) lets foreigners buy individual parcels in a building subdivided under the Strata Titles Ordinance 1995. Law firms citing the 2019 Direction say commercial and residential strata units carry no minimum market value. Some secondary guides quote RM600,000 for strata too, so confirm with your lawyer. Source: Lo & Partners; S.K. Ling & Tan; IQI Global. |
| Landed homes: RM600,000 in Kuching Division, RM500,000 elsewhere | Set by the Land (Market Value of Property for Foreign Acquisition) (Amendment) Direction 2019. The same figures apply to house purchases under the S-MM2H programme. Source: Mondaq; S-MM2H programme page. |
| State approval before you buy | Approval comes through the Land and Survey Department, Sarawak, under ministerial direction; lawyers advise getting it before signing. No published state levy was found. Source: IQI Global; S.K. Ling & Tan. |
| Native land is off limits | Section 8(a) bars non-natives, including Malaysians from outside Sarawak, from Native Area Land, Native Customary Land and Interior Area Land. Source: Mondaq / Low & Partners. |
| Excluded property types | Low-cost and low-cost-plus homes, Bumiputera-reserved units, vacant land and landed commercial property cannot be bought by foreigners. Source: S.K. Ling & Tan; IQI Global. |
| Buy in your own name | Foreigners must buy in their own name and cannot hold jointly with a Malaysian citizen. Source: Low & Partners; Lo & Partners. |
| 8% stamp duty on home transfers from 1 January 2026 | The federal stamp duty on a transfer of residential property to a non-citizen (other than a permanent resident) or foreign company rose from 4% to a flat 8%. Stamp duty is federal, so it applies in Sarawak. Source: KPMG Budget 2026 summary. |

Buying, selling or renting
The steps and costs
Stamp duty, legal fees and RPGT are federal and work the same in Sarawak as elsewhere in Malaysia. Read buying a subsale property, selling your property and renting out a property, and use the buying costs calculator for your own numbers. Foreign-buyer rules are the part that differs by state, so they are set out above.
Straight answers
Sarawak property: frequently asked questions
Can foreigners buy property in Kuching?
Yes. Foreigners can buy strata condominium units with approval from the Land and Survey Department, and landed homes priced at RM600,000 or more in Kuching Division. Native Area Land, low-cost and Bumiputera units are excluded, and stamp duty on homes is 8% from 1 January 2026.
Is there a minimum price for foreigners in Sarawak?
Law firms citing the 2019 Direction say strata units have no minimum. Landed homes need a market value of at least RM600,000 in Kuching Division and RM500,000 in other divisions.
Bolehkah warga asing membeli kondominium di Kuching?
Boleh, dengan kelulusan Jabatan Tanah dan Survei Sarawak. Unit strata tiada harga minimum negeri, tetapi tanah Kawasan Bumiputera (Native Area Land), unit kos rendah dan unit Bumiputera dikecualikan.
