Melaka property

Melaka is a smaller and cheaper market than Johor Bahru or Kuala Lumpur, and most completed condominiums here ask between about RM200,000 and RM500,000. The six projects below run from family flats near Multimedia University in Ayer Keroh to seafront and riverside towers with large units close to RM1 million. Foreign buyers face a lower strata minimum than in Johor, but a 3% state fee, a five-year hold and a ban in the heritage zone.

The rules for foreigners buying in Melaka

Melaka has its own rules, set by the state. Confirm the current position with a lawyer in Melaka before you pay a booking fee.

RuleWhat it means
Minimum price, strata: above RM500,000Foreign individuals and companies may buy a strata home (condominium or apartment) priced above RM500,000. The Malaysian Bar’s state table (as at October 2024) words it as RM500,000 and above.
Minimum price, landed: above RM1 millionLanded homes, including landed strata, need a price above RM1 million. Detached and semi-detached homes are capped at 10% of a project, with land of up to 8,000 sq ft (detached) or 5,000 sq ft (semi-detached).
What a foreigner cannot buyLow-cost and low-medium-cost homes, single and 1½-storey terraces, shops under three storeys, property allocated to Malays, property sold at auction or by court order, and Malacca Customary Land (MCL).
No foreign ownership in the heritage zoneThe state policy says foreign interests may not own property in Melaka’s Heritage Area (Kawasan Warisan). Ask your lawyer to check any city-centre title against the zone.
Quota per projectForeign ownership of condominiums and apartments is limited to 50% of a project in urban areas and 30% outside them; commercial buildings to 30%.
State consent from PTG MelakaEvery purchase, including by permanent residents and MM2H participants, needs State Authority consent through the Melaka Land and Mines Office (Pejabat Tanah dan Galian). Approval is valid for two years.
Processing fee RM5,000, approval fee 3%The state charges RM5,000 per unit to process the application (revised 1 October 2022) and an approval notification fee of 3% of the sale price or RM30,000, whichever is higher. In the secondary market, where a project’s foreign quota still has room, a levy of 3% of the sale price is charged to the seller.
Five-year holdThe unit cannot be transferred (Form 14A) or leased (Forms 15A and 15B) for five years; a registrar’s caveat is entered on the title for 60 months.
MM2H follows the same minimumsMM2H participants face the same RM500,000 strata and RM1 million landed minimums.
8% stamp duty on homes from 1 January 2026Federal rule: transfers of residential property to non-citizens and foreign companies (not permanent residents) pay a flat 8% stamp duty, up from 4%.
Land law: National Land CodeMelaka is a Peninsular state, so the National Land Code 1965 applies, alongside its own Malacca Customary Land titles, which are closed to foreign buyers.

Buying, selling or renting

The steps and costs

Read buying a subsale property, selling your property and renting out a property, and use the buying costs calculator for your own numbers. Foreign-buyer rules are the part that differs by state, so they are set out above.
