Buying a Subsale Property in Johor Bahru: Steps, Costs and Checks

Bahasa Melayu · 中文版

← All Johor projects · Buyer guide · Updated October 2026

A subsale (resale) property is one bought from its current owner rather than from the developer. You can see the actual unit, the view and the neighbours before you pay, and you can move in or collect rent within months instead of waiting years for construction. The trade-offs are higher upfront costs and more checks to do. This guide covers the steps, the real costs, and what to check in Johor.

Steps to buy a subsale property

  1. Set your budget. Get a bank pre-assessment. Banks usually lend up to 90% for your first two properties and up to 70% from the third.
  2. Shortlist and compare prices. Compare asking prices with recorded transactions in the same building, available from the NAPIC open transaction data or through Jason.
  3. View and check the unit. Check defects, water pressure, the view, parking, and the management office’s statement of arrears.
  4. Offer and earnest deposit. Sign an offer to purchase with an earnest deposit, usually 2% to 3%, subject to contract.
  5. SPA and the 10% deposit. Your lawyer runs a land search and bankruptcy search, then you sign the SPA and pay the balance of the 10% deposit.
  6. Loan and consents. The bank values the unit and issues the loan. State consent is needed for leasehold land, Bumiputera lots and foreign buyers.
  7. Completion. Usually 3 months from the SPA or consent, with a 1-month extension at interest. The balance is released to the seller.
  8. Transfer and keys. The title is transferred to you and the keys are handed over.

First home? Malaysian citizens buying their first residential property at RM500,000 or below pay no stamp duty on the transfer or the loan agreement for SPAs signed from 1 January 2026 to 31 December 2027. In the example above that saves RM11,250.

Foreign buyer? From 1 January 2026, foreigners pay 8% stamp duty on the transfer of residential property, and in Johor generally need a property priced at RM1 million or more plus state consent, and pay Johor’s consent levy of 3% of the price or RM30,000, whichever is higher (since 1 July 2025). See projects for foreign buyers.

What to check before you pay a deposit

  • Title and tenure. Freehold or leasehold, and how many years remain on the lease. Banks may limit loans when little time is left.
  • Restrictions on the title. Bumiputera lots, Malay Reserve land and leasehold land need state consent; some cannot be sold to non-Bumiputera or foreign buyers at all.
  • Strata title issued? If not, the sale goes through a deed of assignment and the developer’s consent, which adds fees and time.
  • Arrears. Ask for the management office’s statement of maintenance and sinking fund, and recent quit rent and assessment receipts.
  • Existing tenancy. A tenanted unit may come with a tenant whose agreement continues after the sale.
  • Bank valuation. If the bank values the unit below the price, you pay the difference in cash, so check recorded prices first.

Buying a subsale property in Johor: quick answers

How much cash do I need to buy a RM500,000 subsale property?

Plan for about RM75,000 to RM78,000: the 10% deposit, about RM11,250 in stamp duty, and about RM12,000 in legal fees plus SST and disbursements. A first-time Malaysian buyer at RM500,000 or below may save the RM11,250 stamp duty.

How long does a subsale purchase take?

Commonly three to four months from the SPA to getting the keys. It can take longer when state consent is needed, for example for leasehold land, a Bumiputera lot or a foreign buyer.

Is subsale better than a new launch in Johor Bahru?

Subsale suits buyers who want to move in or rent out soon and see exactly what they are buying. New launches suit buyers who want a brand-new unit and can wait. Compare recorded subsale prices in the same area before paying a new-launch premium.

Can a foreigner buy a subsale property in Johor?

Yes, if the unit meets the Johor minimum price for foreigners (generally RM1 million or more) and is not a Bumiputera, low-cost or restricted unit. State consent is required and stamp duty for foreigners buying a home is 8% from 2026.
