Perlis rules

What applies to foreign buyers and sellers in Perlis

State rules as summarised on the Perlis property page; confirm the current position with your lawyer before you sign.

Minimum price: RM500,000 (sources differ)

iProperty (Feb 2026), PropertyGuru (May 2026) and HousingWatch (2026) give RM500,000 for both strata and landed homes. Low & Partners’ table gives RM1 million. We found no official Perlis guideline online, so confirm with a Perlis lawyer.

State Authority consent

Every purchase by a non-citizen or foreign company needs State Authority consent, applied for through your lawyer at the Perlis Land and Mines Office (PTG Perlis).

Application fee: RM500 per title

Perlis Land Rules 2024, Schedule item 80, in force from 1 January 2025.

Ownership fee: 5% of the JPPH valuation

For residential, commercial and agricultural land, per title (item 81). It is worked out on the government valuation, not your price. Industrial land pays a flat RM5,000 (individual) or RM20,000 (company).

8% stamp duty on homes from 1 January 2026

Federal rule: transfers of residential property to non-citizens and foreign companies (not permanent residents) pay a flat 8% stamp duty, up from 4%.

Land law: National Land Code

Perlis is a Peninsular state, so the National Land Code 1965 applies; the Perlis Land Rules 2024 are made under it.

Timeline

Steps to sell

  1. Valuation and pricing (1–3 days): recorded prices, an asking price and the agent fee agreed in writing.
  2. Marketing and viewings (typically 1–3 months, depending on price and condition).
  3. Offer and earnest deposit (2–3%) from a buyer whose loan eligibility has been checked.
  4. SPA signed within about 14 days; the buyer pays the balance of the 10% deposit and the RPGT retention is held.
  5. Completion usually 3 months from the SPA or state consent, plus a 1-month extension if needed; your loan is redeemed and the balance released.

Straight answers

Frequently asked questions

How much RPGT do I pay if I sell in Perlis?

RPGT is a federal tax and the same in every state: 30% of the gain within three years, then 20%, 15% and 0% for Malaysian individuals from the sixth year. Foreigners pay 30% within five years and 10% after.

How long does it take to sell a property in Perlis?

Marketing usually takes one to three months for a well-priced unit, then about three months from the SPA to completion, longer if the buyer needs state consent.

Can a foreign owner sell to another foreigner?

Yes, if the buyer meets the Perlis rules for foreign buyers (Minimum price: RM500,000 (sources differ)) and obtains state consent; check any minimum holding period in the state rules above.

Should I sell or rent out?

It depends on your loan, the rent the unit can achieve, how long you have owned it (RPGT) and whether you need the cash. Jason can compare both for your unit.
